Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an mistake. Following his return to the United States to face human smuggling charges, he was detained in immigration custody.
In her order, the judge noted that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Context of the Case
The legal challenge center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
Conditions of Release
The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
This decision marks a significant turn in a complicated immigration case involving claims of wrongful detention and disputed criminal affiliations.
